(PatriotPostNews.com) – A judge has ruled that the district attorney prosecuting former president Donald Trump for alleged election interference may remain on the case if she or the special prosecutor with whom she was romantically involved is dismissed.
Fani Willis, the district attorney for Fulton County, has been prosecuting the last remaining GOP candidate for the 2024 presidential election over allegations that he and some members of his team tampered with election results in Georgia during the 2020 presidential race.
Over the past two months, attorney Ashleigh Merchant exposed a romantic relationship between Willis and her hired special prosecutor, Nathan Wade. Merchant argued on behalf of one of Trump’s co-defendants, Michael Roman, that the affair was “improper” and interfered with the case. Roman, later joined by Trump and other co-defendants, petitioned to have the prosecutors removed and their charges dropped.
On March 15, Judge Scott McAfee ruled that the “appearance of impropriety” was present in the relationship between Willis and Wade but did not find the affair to have developed a conflict of interest in the case. Subsequently, he denied claims and requests from defendants to have the charges dropped.
However, McAfee did insist that, in order to remain on the case, the prosecuting team would need to dismiss either Willis or Wade. The judge added in the decision that his ruling does not translate to the court’s support of the district attorney’s “tremendous lapse in judgment” or her “unprofessional manner” in which she presented herself during an evidentiary hearing in February.
McAfee added that a conflict of interest in this situation did not hold up to qualifications under Georgia law, which does not include “making bad choices […] repeatedly.”
Following the ruling, Wade submitted his resignation from his role as special prosecutor of the case, which was accepted by Willis.
Trump’s lawyer stated after the decision that it had belittled the “significance” of the misconduct between the prosecutors and declared that his team would “use all legal options” to “fight” the case moving forward.
