The Supreme Court To Review Whether Federal Law Overrides Idaho’s Abortion Ban

(PatriotPostNews.com) – The Supreme Court will decide if Idaho’s abortion ban could be sidestepped by a federal law that dictates that hospitals provide “emergency” abortions. The federal law in question is the 1986 “Emergency Treatment and Active Labor Act” (EMTALA). The law was designed to help patients who may otherwise be turned away due to financial shortcomings. Under President Joe Biden, the Justice Department pushed back on Idaho and asserted that allowing abortion exclusively in the case of saving the mother’s life was too narrow.

Pro-life advocates assert that Biden is overstepping his bounds by using federal powers to manipulate state law. With the overturning of Roe v. Wade, the US Health Department released guidance stating that EMTALA protects abortionists from legal action and allows providers to end the life of unborn children in “emergency situations.”

The Justice Department claims that the Idaho law would cut off women’s access to emergency life-saving “reproductive care”. Pro-life groups have pushed back and asserted that the Justice Department is muddying the waters and creating unnecessary confusion for medical providers. Pro-life organizations in Idaho affirm that the state’s anti-abortion laws are clear.

The Biden administration is working to expand HIPAA to offer more robust legal protections for abortionists in states where the practice of terminating the unborn remains legal. The increased protections prevent healthcare data from being released to state officials, even for cases involving lawsuits and legal investigations. The expansion also protects would-be mothers who cross state lines to subvert the law and receive an abortion outside of her home state.

The Biden administration is attempting to stir up controversy by linking former President Donald Trump to a new Florida abortion law. The law prohibits abortion at any time after six weeks of pregnancy. Florida has been leaning red since 2012. Biden is hopeful that by leveraging Florida’s controversial abortion law, he can reclaim the state in time for the 2024 presidential election.
